Freedom of Assembly and Association In the month of August, ZPP recorded more than 20 cases related to freedom of assembly and association. Mashonaland Central had the highest number of violations, followed by Mashonaland West, Manicaland and Mashonaland East. A CCC rally scheduled for 17 August at Mvurwi stadium was allegedly barred by Mvurwi Town Council. Reports indicate that Mvurwi Town Council employee Shirley Nyakudya turned down the CCC application whose main speaker was CCC president Nelson Chamisa. CCC members in Mvurwi accused Zanu PF of influencing the council to bar their rally. According to Section 58 of the Constitution, every Zimbabwean has the right not to assemble or associate with others nor be compelled to belong to an association or to attend a meeting or gathering. The African Charter on Human and Peoples’ Rights, Article 10 states that, “every individual shall have the right to assemble freely with others.” In addition, Article 11 states that, “every individual shall have the right to freedom of movement.” The right to freedom of association is guaranteed under Articles 12(3), 27(2) and 28 of the African Charter on Democracy, Elections and Governance. Right to administrative justice In the month of August, ZPP recorded 16 cases on the right to administrative justice. Harare had the highest number with 13 cases and Manicaland and Mashonaland Central had a case each. On 11 August in ward 6 of Kwekwe CBD it was reported that five Zanu PF youths ordered informal traders (vendors) who sell their wares in the open spaces of the CBD near Spar, OK, TM Pick n Pay and POSB, to knock off before their usual knockoff time. It is alleged that the youths accused the traders of betraying them by voting for a CCC member for the Kwekwe Central Parliamentary seat instead of voting for Energy Dhalla Ncube, a Zanu PF candidate. Vendors were also warned that they will be beaten if they continue to support CCC activities. Section 68 of the Constitution stipulates that every Zimbabwean has a right to administrative conduct that is lawful, prompt, efficient, reasonable, proportionate, impartial and both substantively and procedurally fair. Property rights In the month of August, ZPP recorded a total of 12 cases on property rights. Manicaland recorded 4 cases and Mashonaland West recorded 2 cases. On 14 August in ward 12 of Chiredzi South, it was reported that a CCC member had the gazebo of his homestead burnt to ashes by suspected FAZ members led by a man called Sham Mazarire. Allegedly, the victim was targeted for being the Chief Elections agent. The matter was reported to the ZRP with RRB 554075. Section 71(3) of the Constitution stipulates that no person may be compulsorily deprived of their property except where conditions are satisfied. Page 12
