Right to personal security
ZPP recorded a total of 10 cases in which the right to personal security was violated.
These were recorded in different areas and Manicaland was the province with the
highest with four cases, and the provinces that recorded the lowest were Mashonaland
West and Manicaland with one case each.
On 31 January at Zengeza 3 shops, Zengeza West, Chitungwiza, a CCC activist was
assaulted by former Zanu PF Ward 11 Councillor Xavier Jima for wearing yellow. Reports
confirm that Jima attacked the activist with open palms for wearing a yellow T-shirt and
chanting the CCC slogan “Ngaapinde Hake Mukomana”. In Nyanga South, ward 15, on 21
January 2023, it was reported that unknown and yet-to-be-identified assailants
assaulted Francis Fombe for allegedly wearing an opposition CCC t/shirt. Unfortunately,
reports suggest that Fombe succumbed to the injuries sustained from the assault.The
case was said to have been under investigation, but the reasons for the assault were
suspected of having been political since he was assaulted while wearing an opposition
CCC t/shirt.
Section 52 of the Constitution states that every Zimbabwean has the right to bodily and
psychological integrity, which includes the right to freedom from all forms of violence
from public or private sources. Articles 3 and 5 of the UDHR recognise that every person
has the right to personal liberty and security, and this is supported by Article 6 of the
ACHPR.
